2021 NOTICES
September 17, 2021
Parliament enacted legislation, in force as of August 3, 2021, to proclaim a National Day for Truth and Reconciliation. September 30 is now a statutory holiday for federal public sector workers and employees covered by Part III of the Canada Labour Code. The day is intended to honour Survivors, their families, and communities, and to ensure that public commemoration of the history and legacy of residential schools remains a vital component of the reconciliation process.
This year, given the late implementation date of the National Day for Truth and Reconciliation, Saskatchewan’s courts will carry on with previously scheduled matters in order to avoid delays that might cause disadvantage and inconvenience for accused persons and litigants.
In the days ahead, the courts will consider the measures that might be appropriately taken in relation to the ongoing recognition of the National Day of Truth and Reconciliation.

The Court of Appeal reminds litigants that, with the exception of sections 17 and 24 of Chapter 19, The Miscellaneous Statutes (Appeal Provisions) Amendment Act, 2021, SS 2021, c 19 and The Miscellaneous Statutes (Appeal Provisions) Amendment Act, 2021, (No. 2), SS 2021, c 20, will come into force on September 1, 2021. These Acts make modifications to the rights of appeal to the Court found in a number of statutes.

In an upcoming appeal, the Court of Appeal will be examining the current test for leave to appeal in property tax matters as set out in Saskatoon (City) v North Ridge Development Corporation, 2015 SKCA 13, 451 Sask R 265.
Entities who might wish to seek intervenor status in that appeal for the purpose of speaking to this issue are advised to immediately contact the Registrar of the Court (caregistrar@sasklawcourts.ca or 306-787-5358) for further information.

Court Services has announced important improvements to Deposit Accounts in the Court of Queen’s Bench. All current deposit accounts will be canceled on August 7, 2020.
To obtain a new central deposit account for use at any judicial centre, court users must file a written request in the prescribed form with any Local Registrar. More information on the changes and the form for Requesting a new Provincial Deposit Account can be found here

Chief Justice M.D. Popescul of the Court of Queen’s Bench has canceled the Court’s regular civil Chambers on June 7, 2018, and family law Chambers on June 8, 2018, in both Regina and Saskatoon. All matters that have been set for Chambers in either Regina or Saskatoon on those dates will be adjourned by the Local Registrar to subsequent Chambers dates. The Local Registrar will notify the applicants and respondents (whose address is known) of the Chambers date to which it has been rescheduled.

The Court of Queen’s Bench has amended the Rules of Court and related forms effective April 1, 2017.
The amendments include authorizing lawyers to send requests for service directly to foreign countries pursuant to The Hague Convention on the Service Abroad of Judicial and Extrajudicial Documents in Civil and Commercial Matters, and amending the family law Petition and Answer forms to require additional information concerning other relevant court proceedings and to update the Statement of Lawyer. The Court of Queen’s Bench has made a number of amendments to its Rules of Court and related forms. The amendments take effect on January 1, 2016. The amendments include the requirement that originating applications be issued before they are served; clarification on when issues may be resolved by summary judgment; the requirement that proof of death (such as a funeral director’s certificate) be filed with applications for probate and adminstration; changes to the Application for Grant of Adminstration form to clarify the basis on which a bond is or is not required; new forms for Application for Case Conference and Appointment for Questioning; as well as formatting amendments to all forms including the removal of the clerk’s stamp.
