Assessment of Costs

Court of Appeal

When the Court grants cost of an application or appeal to one of the parties and does not fix a specific dollar amount of costs, and the parties are not able to agree on the dollar amount of costs payable, Rule 54 of The Court of Appeal Rules authorizes the Registrar to assess or “tax” costs in accordance with the Court’s Tariff of Costs and sets out the process for having the Registrar do this.

The following decisions of the Registrar, indexed by subject and date, might be useful for parties who are trying to determine what dollar amount is payable as a result of an award of costs.
