The Court of Queen’s Bench has approved the Protocol for the Management of Multi-Jurisdictional Actions. The Protocol was developed by the Canadian Bar Association Task Force on Class Actions and recently approved by the Canadian Judicial Council.
The Protocol consists of Notice of Obligations set out in paragraphs 3 to 6, and a Settlement Approval Protocol set out in paragraphs 7 to 14. Section 2 of the Protocol sets out the procedure for determining whether the Protocol will be applied in whole or in part in any one action
